The case study I chose is Schrems II: Cross-Border Data Transfers and Privacy. The ethical dilemma in this case is about whether companies should be allowed to send user data to other countries when the other countries have different privacy protection laws. In the case study, the EU ruled that the Privacy Shield agreement between the US and the EU did not adequately protect EU citizens. This is a complex issue because of how intermingled laws, technology, and human values are. The EU has very strict privacy laws under the GDPR, whereas the US is more ‘flexible.’ Data is often sent to other countries to operate social media platforms, trade, and other things. People want global services, but also want their personal information to remain as secure as possible.

With the amount of data breaches there have been, especially in the U.S., it makes sense why European citizens would be wary about having their data sent here; if there data does get sent to the U.S., then they are certainly losing on the privacy rights dictated through the European Union laws. This is both an ethical and legal issue. Legally, it brings concern over whether or not international agreements meet the standards of privacy laws. Ethically, it raises questions about privacy vs profit.
