The fire service has been the subject of many litigation issues. Harassment and discrimination issues highlight many of the cases brought against a fire department. There are seven protected classes that local, state, and federal governments must consider in the protection of an employee from harassment and discrimination.

For this essay, you are to pick one of the protected classes to write on regarding harassment and a separate protected class to write on regarding discrimination.

Protected Classes:

1. Age

2. Disability

3. Genetic Information

4. National Origin

5. Race/Color

6. Religion

7. Sex including gender identity/expression, sexual orientation, pregnancy, and equal pay

1. Discuss your two protected classes and the key statutes involved with those protected classes.

2. Discuss how harassment affects your chosen protected class.

3. Discuss how discrimination affects your chosen protected class.

4. Discuss an employee’s rights against retaliation from an employer.

5. How have harassment and discrimination issues affected the fire service?

6. Research one fire service related court case that deals with harassment and one that deals with discrimination.

The information for each case must include the facts, the issues, the holdings, and the rationale of the case. Each is explained below:

A. What are the Facts of the case? The facts are the court’s explanation about what happened and the history of the case. Basically, what occurred and what caused the case to go to court.

B. What are the Issues with the case? The issue or issues is the legal question which the judge or judges have concluded must be addressed in order to decide the case.

C. What is the Holding or ruling of the court? The holding is essentially the court’s answer to the issue or issues that have been identified.

D. What is the Rationale by the court? The rationale is the reasoning stated by the court in reaching its conclusion.

4. Headings Headings are required in the paper so that the reader can distinguish between your key points throughout the body of the paper.

5. Citing Sources Cite your quoted and paraphrased material using APA 7^th Edition
6. Reference Page Reference all material using APA 7^th Edition and be sure to pay attention to the indentations for each source.
